The law of distress may be archaic, but there is a need for Certificated Bailiffs and we aim to fulfill that need. Deserted Tenements Act 1817:- This statute permits a landlord to utilize the services of a Certificated Bailiff where the tenant has disappeared. Take the scenario of the troubled tenant; he is in arrears with his rent but the landlord permits him to stay in occupation of the premises upon certain promises being made. If the tenant is unable to keep his word and basically just throws his hand in, then the landlord may have an extremely difficult task of getting the lease back in order to re-let the property. This act states that where the rent is six months or more in arrears that a Certificated Bailiff may apply to Magistrates Court for that lease to be declared void and allow for a completely new lease to be issued. Forfeiture of Business Premises:- The peaceful re-entry of business premises is an often-used means of dealing with an errant tenant. It allows the landlord back into his property and hopefully a return on his investment.
